New rules came into effect on 20 March 2020 which simplify a change of employer for employee and blue cards holders. For the time being, they are to be in effecti until the end of the state of emergency, i.e. at least until 12 April 2020.
Whereas previously, an employee card holder could change the employer only after 6 months of residence in the Czech Republic, this condition does not apply now, and foreigners can change their employer earlier. However, this change still needs to be reported to the Ministry of the Interior and it is necessary to wait until the Ministry issues a “notification” that the conditions for this change are met.
Another change is that if the new employer implements or assists in implementing crisis measures, then it is sufficient if this change is reported to the Ministry on the day employment commences, at the latest. There is no need to wait for the aforementioned “notification”. However, the foreigner will have to submit a statement from the employer confirming that his/her work activity will be related to carrying out crisis measures.
However, other obligations of the foreigner and the employer, such as, in particular, notifying the Labour Office that the foreigner has entered into employment, continue to apply.
