As of 1 January 2023, the amended Act No. 300/2008 Coll., on Electronic Acts and Authorized Conversion of Documents came into force, on the basis of which the category of persons to whom the Ministry of the Interior has automatically set up a data-mailbox has been extended.
From now on, all persons registered in the Basic Register of Legal and Natural Persons (so called ROS Register have data-mailboxes automatically set up by law.
In the case of freelancers, it is important to mention that the data-mailbox is created automatically even for those persons who currently have their trade license suspended.
The above mentioned in fact means, it means that freelancers with suspended trade licenses cannot apply for either the data-mailbox to be made inaccessible or to be cancelled. Only persons who are not entrepreneurs can make the data-mailbox inaccessible, for example, at the nearest Czech POINT office or directly in the settings of the data-mailbox itself. Messages cannot be delivered to or sent from the inaccessible date-mailbox, but previously saved messages can still be accessed.
The cancellation of the data-mailboxes is done by the Ministry of the Interior and only based on reasons stipulated by law. The actual cancellation happens 3 years after the data-mailbox was made inaccessible.
Therefore, the only way for a person with suspended trade license to prevent the mandatory set-up of a data-mailbox is to cancel the trade license or other authorization to do business. Upon striking off from the relevant register, the data-mailbox is then automatically made inaccessible and then cancelled after 3 years.
